LEGAL BASIS AND THE RESPONSIBILITIES OF THE LEGAL DEPARTMENT

The Legal Department  as an organizational unit of the Ministry of Justice, based on the powers of  Ministry of Justice foreseen with the Regulation  no. 02/2011 on the areas of administrative  responsibility of the Office of the Prime Minister and Ministries, Appendix I, Regulation of Rules and Procedure of the Government of the Republic of Kosovo no.09/2011,as well as the respective laws and sub-legal acts, has the following duties and responsibilities: 

1. Propose, draw up and ensure the implementation of strategies/policy documents within the scope of the Ministry; 

2.Propose, draw up and ensure the implementation of primary and secondary legislation within the scope of the Ministry; 

3.Ensure compliance of proposed legislation by the Ministry with European Union legislation (Acquis), the Constitution and applicable laws in the Republic of Kosovo;

4.Provide recommendations and legal advice to Ministry structures, upon request; 

5. Cooperate with State advocacy Office for judicial representation process of the Government and other public authorities; 

6.Provide legal support to the draw up of draft decisions and other documents, upon request. 

The Legal Department comprises of the Division on the Draw Up and Harmonization of Legislation and Division on Overseeing the Implementation of Legislation, Legal Support and Cross-Institutional Cooperation in the area of Legislation.
