Legal Department

The mission of the Legal Department is for the legal framework of the justice system to be qualitative and in accordance with the constitutional order, aligned with the legislation of the European Union (EU Acquis) and international standards.

 

The duties and responsibilities of the Legal Department are:

  • Proposes, drafts and ensures the implementation of primary and secondary legislation, for the justice system and from the scope of the Ministry;
  • Harmonizes the legislation proposed by the Ministry with the EU Acquis, international standards, and applicable laws in the Republic of Kosovo;
  • Provides recommendations and legal advice for the structures of the Ministry as well as legal support in the drafting of various documents;
  • Prepares legal opinions from the scope of the Ministry, upon request;
    Supports the preparation of policy documents from the scope of the Ministry;
  • Cooperates with the State Bar in representing the Government and other public authorities in judicial and arbitration proceedings.

 

The Director of the Legal Department reports to the General Secretary.

 

The Legal Department consists of the following divisions:

– Division for Criminal Legislation and Organization of the Justice System;
– Division for Civil and Administrative Field Legislation.

1.1 Division for Criminal Legislation and the Organization of the Justice System

The duties and responsibilities of the Division for Legislation in the Criminal Field and for the Organization of the Justice System are:

  • Proposes, drafts and ensures the implementation of legislation from the criminal field and of the institutional and organizational nature of the justice system;
  • Aligns the legislation of the criminal field and the institutional and organizational nature of the justice system with the EU Acquis and international standards;
  • Provides recommendations and legal advice for the structures of the Ministry;
  • Provides legal support in the drafting of draft decisions, draft agreements, draft memoranda, draft contracts and other documents;
  • Prepares legal opinions from the criminal field and the institutional and organizational nature of the justice system, upon request;
  • Provides support in the preparation of strategic documents and concept documents for areas related to the scope of the Division;
  • Evaluates the implementation of legislation from the criminal field and the institutional and organizational nature of the justice system, for the implementation of existing provisions in force and proposes concrete measures related to them;
  • Provides recommendations and legal advice, as well as supports the preparation of documents and other relevant documents for the State Bar, in judicial and arbitration procedures, related to the scope of the Division;
  • Provides comments to the relevant institutions in the phase of preliminary consultations if the draft acts contain provisions of a penal or misdemeanor nature, as well as proposes them or recommends their change.

1.2 Division for Civil and Administrative Field Legislation

The duties and responsibilities of the Division for Civil and Administrative Legislation are:

  • Proposes, drafts and implements legislation from the civil and administrative fields;
  • Aligns the legislation of the civil and administrative field with the EU Acquis and international standards;
  • Provides recommendations and legal advice for the structures of the Ministry;
  • Provides legal support in the drafting of draft decisions, draft agreements, draft memoranda, draft contracts and other documents;
  • Gives legal opinions from the civil and administrative fields;
  • Supports the preparation of strategic documents and concept documents for areas related to the scope of the Division;
  • Evaluates the implementation of legislation from the civil and administrative fields, for the implementation of existing provisions in force and proposes concrete measures related to them;
  • Provides recommendations and legal advice, as well as supports the preparation of documents and other relevant documents for the State Bar, in judicial and arbitration procedures, related to the scope of the Division;
  • Provides comments for the relevant institutions in the phase of preliminary consultations for the connection of the draft acts with the legislation of the civil or administrative field.
