Department for International Legal Cooperation

The mission of the Department for International Legal Cooperation is the efficient operation of international legal cooperation between the Republic of Kosovo and other countries, as well as international organizations.

The duties and responsibilities of the Department for International Legal Cooperation are:

  • Proposes, drafts, negotiates and ensures the implementation of agreements in the field of international legal cooperation, between the Republic of Kosovo and other states, as well as international organizations;
  • Provides support in the procedure of signing and ratifying international agreements in the field of international legal cooperation;
  • Analyzes public policies and drafts periodic reports with recommendations, in the field of international legal cooperation;
  • Participates in domestic and international forums on issues of international legal cooperation;
  • Handles requests for international legal cooperation, in accordance with the relevant legislation in force;
  • Provides legal opinions on issues that belong to the field of international legal cooperation;
  • Cooperates mutually with local and international institutions in the field of international legal cooperation;
  • Provides official information and reports with recommendations for the hierarchy of the ministerial system regarding the issues that belong to the field of international legal cooperation;
  • Drafts and processes requests, decisions and other relevant documents related to extradition, transfer of convicted persons, international child abduction and other issues in the field of international legal cooperation;
  • Provides support in the drafting of policy documents, the drafting and evaluation of the implementation of legislation in the field of international legal cooperation.

The Director of the Department for International Legal Cooperation reports to the Secretary General.

 

The Department for International Legal Cooperation consists of the following divisions:

  • Division for International Legal Cooperation in Criminal Matters;
  • Division for International Legal Cooperation in Civil Matters.

Division for International Legal Cooperation in Criminal Matters

The duties and responsibilities of the Division for International Legal Cooperation in Criminal Matters are:

  • Drafts, proposes and provides the necessary support for the implementation of agreements between the Republic of Kosovo and other states, as well as international organizations, for international legal cooperation in criminal matters;
  • Prepares all documents and follow-up documents according to the Law on International Agreements that are needed for the initiation, negotiation, authorization and ratification of international agreements for international legal cooperation;
  • Provides support in the preparation and processes documentation for extradition procedures, interstate transfer of convicted persons and other legal cooperation procedures in criminal cases;
  • Monitors compliance with Kosovo’s obligations defined by international agreements for international legal cooperation and drafts periodic reports with recommendations;
  • Analyzes local and international public policies in the field of international legal cooperation in criminal matters and drafts periodic reports with recommendations;
  • Provides legal opinions on issues that belong to the field of international legal cooperation, in the criminal aspect;
  • Cooperates mutually with local and international institutions, in the field of international legal cooperation in criminal matters;
  • Cares for recording and updating data for international legal cooperation in the electronic database;
  • Accepts, administers and responds to subjects within the scope of the Division;
  • Prepares and processes all letters that come out of the Division addressed to institutions inside and outside the Republic of Kosovo, also ensuring that they are forwarded on time;
  • Maintains the files of the Division, takes care of their archiving, as well as fulfills all other administrative tasks, and
  • Proposes and provides support in the drafting and review of policies and primary and secondary legislation on issues related to international legal cooperation in criminal matters.

The Head of the Division for International Legal Cooperation in Criminal Matters reports to the Director of the Department for International Legal Cooperation.

Division for International Legal Cooperation in Civil Matters

The duties and responsibilities of the Division for International Legal Cooperation in Civil Matters are:

  • Drafts and provides the necessary support for the implementation of agreements between the Republic of Kosovo and other countries for international legal cooperation in civil matters;
  • Prepares all documents and follow-up documents according to the Law on International Agreements that are needed for the initiation, negotiation, authorization and ratification of international agreements for international legal cooperation;
  • Provides support in the preparation and processes requests for international mutual legal assistance in civil cases, as well as relevant documents for the civil aspects of international child abduction;
  • Monitors compliance with Kosovo’s obligations defined by international agreements for international legal cooperation and drafts periodic reports with recommendations;
  • Analyzes local and international public policies in the field of international legal cooperation in civil matters and drafts periodic reports with recommendations;
  • Provides legal opinions on issues that belong to the field of international legal cooperation, in the civil aspect;
  • Cooperates mutually with local and international institutions, in the field of international legal cooperation in civil matters;
  • Cares for recording and updating data for international legal cooperation in the electronic database;
  • Accepts, administers and responds to subjects within the scope of the Division;
